Privacy and Policy

Welcome to Petrotank South Africa (the “website”).

We understand that privacy online is important to users of our website, especially when conducting business.
This statement governs our privacy policies with respect to those users of the Site (“Visitors”) who visit without transacting business on the Site and make use of the various services offered by Petrotank South Africa (collectively, “Services”) (“Authorized Customers”).

POPIA – The protection of personal information ACT

The POPI Act is a new privacy law, effective from 1 July 2021 in South Africa and designed to protect people’s private information.  It covers the sourcing, usage and storage of personal Information relating to “natural persons”.

According to the POPI Act, personal information includes but is not limited to:

  • Information relating to the race, gender, sex, pregnancy, marital status, national, ethnic or social origin, colour, sexual orientation, age, physical or mental health, well-being, disability, religion, conscience, belief, culture, language and birth of the person;
  • Information relating to the education, medical, financial, criminal and employment history of the person;
  • Names, surnames, nicknames and identifying numbers, email addresses, physical addresses, telephone numbers, location, online identifiers and the like;
  • Biometric information of the person;
  • Personal opinions, views and preferences of the person;
  • Correspondence sent by the person that is implicitly or explicitly of a private or confidential nature or further correspondence that would reveal the contents of the original correspondence;
  • Views or opinions of other individuals about the person.

The POPI Act ensures that people’s personal information is appropriately protected, used only for the purposes it was obtained, and in a manner that facilitates transparency around:

  • What companies and other entities do with their clients’ personal information;
  • Why and how this personal information is processed (collection, usage, sharing, disposal, storage and archiving etc);
  • Who the personal information is shared with (third parties locally and internationally, legal entities etc);

Petrotank South Africa is legally compliant with the requirements of the Protection of Personal Information Act (“POPIA”).  To this end, we are committed to protecting our clients’ personal information, which will only be used for the purposes agreed by them.

This Privacy Policy (“Policy”) was compiled to give you confidence as you visit and use the website, to understand what is done with your information, and to demonstrate our commitment to fair-minded legally compliant information practices. We do not process any personal information directly on our site, as our site is to inform out Users (“Visitors”) .

We may process your personal information when you yourself give it to us, for example when you contact us. We’ll only use it for this purpose.
Our website uses analytics or analysis tools for statistical analysis of user behaviour. Your IP address will be anonymized immediately during this process so that you are not identifiable to us as a user. We use this de-identified data to:

  • see what, generally speaking, people are interested in.

We do not knowingly collect any Personal Information from children under the age of 18. If you are under the age of 18, please do not submit any Personal Information through the Website and Services. The Website and Services does not use Cookies.

We encourage you to be aware when you leave the Website and Services and to read the privacy statements of each and every resource that may collect Personal Information.

Information security

We secure information you provide on computer servers in a controlled, secure environment, protected from unauthorised access, use, or disclosure. We maintain reasonable administrative, technical, and physical safeguards in an effort to protect against unauthorised access, use, modification, and disclosure of Personal Information in our control and custody. However, no data transmission over the Internet or wireless network can be guaranteed. Therefore, while we strive to protect your Personal Information, you acknowledge that:

(ii) The security, integrity, and privacy of any and all information and data exchanged between you and the Website and Services cannot be guaranteed;

(iii) And any such information and data may be viewed or tampered with in transit by a third party, despite our best efforts.

Data breach

In the event we become aware that the security of the Website and Services has been compromised or users’ Personal Information has been disclosed to unrelated third parties as a result of external activity, including, but not limited to, security attacks or fraud, we reserve the right to take reasonably appropriate measures, including, but not limited to, investigation and reporting, as well as notification to and cooperation with law enforcement authorities. In the event of a data breach, we will make reasonable efforts to notify affected individuals if we believe that there is a reasonable risk of harm to the user as a result of the breach or if notice is otherwise required by law. When we do, we will post a notice on the Website.

Changes and amendments

We reserve the right to modify this Policy or its terms relating to the Website and Services from time to time in our discretion and will notify you of any material changes to the way in which we treat Personal Information.
